A PENSIONER attacked by lottery rapist Iorworth Hoare has won the right to sue him for a share of his £7million winnings.
The former teacher, who is in her 70s, was attacked by Hoare in Leeds in 1988.
Hoare, 59, who had six previous convictions for rape and other sex offences, was jailed for life for attempting to rape the woman.
Shortly after his release on licence in May 2004, he won £7million on the National Lottery.
His victim, who was 59 at the time of the attack, sued for damages when she heard of his win.
There is a six-year time limit in which such claims must usually be launched.
She did not issue her case against Hoare, who now reportedly lives in a £700,000 house near Newcastle, until 16 years and 10 months after the attack.
But yesterday, Mr Justice Coulson waived the time limit in what he described as a "wholly exceptional" case.
He rejected claims by Hoare's legal team that the fact he had served his jail term meant he now had "a clean slate".
The judge said: "Hoare does not, nor could he ever have, a clean slate."
